Workers’ Compensation Decisions Emphasize Confusion Regarding Medical Marijuana

(Winter 2018) This past June, two conflicting decisions came down from Maine and New Jersey on the issue of workers’ compensation and medical marijuana. In the Garden State, it was determined that a township must cover the cost of an injured worker’s medical marijuana — the first ruling of its kind in the nation. On the flip side, in nearby Maine, it was declared that underwriting the cost of medical marijuana through workers’ compensation made an employer complicit in breaking federal law.

It is only a matter of time before the issue arises again and more judges weigh in on the subject.
