D.C. Bans Pre-Employment Marijuana Testing

(Spring 2015) The District of Columbia Council recently passed legislation to ban an employer from testing for marijuana until a conditional job offer has been made – unless otherwise required by law. Since Washington D.C. has legalized the recreational use of marijuana, a pre-employment test may demonstrate that the candidate used marijuana at some time prior to testing.  The intention behind this new law is to prevent the loss of job opportunities for job seekers based on the potential employee’s marijuana use.

This law specifically states, however, that once a prospective employee has been extended a job offer, marijuana can be included in a drug test panel and the employer may deny a position based on a positive test. The law also allows employers to implement and enforce a workplace drug policy that includes marijuana restrictions.
